Terms of Service

These Terms of Service ("Terms") govern your use of the website ctp.doctor and any associated services, forms, or communications (together, the "Platform"), operated by Work Cover Doctors Australia Pty Ltd (ABN 59 683 397 506) trading as CTP Doctor ("CTP Doctor", "we", "us", or "our").

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.

CTP Doctor is a coordination and referral service focused on people injured in motor vehicle accidents in New South Wales and navigating the Compulsory Third Party (CTP) injury scheme. We provide general information about CTP-related processes and may facilitate connections between you and independent third-party service providers, including medical practitioners, allied health professionals, legal representatives, and related professionals ("Service Providers").

CTP Doctor does not itself provide medical, legal, or allied health services. Any professional advice, diagnosis, treatment, or legal representation is provided solely by the Service Provider you engage. We do not employ, manage, or control Service Providers and are not responsible for their actions, omissions, or advice.

By using the Platform, you represent and warrant that:

• You are at least 18 years of age, or are using the Platform under the supervision of a parent or guardian;
• You are legally capable of entering into binding agreements; and
• All information you provide is accurate, complete, and not misleading.

We may suspend or terminate access if we reasonably believe these conditions are not met.

You agree to:

• Provide accurate and complete information when submitting any form or enquiry;
• Use the Platform only for lawful purposes and in line with these Terms;
• Not impersonate another person or misrepresent your identity;
• Not interfere with the operation or security of the Platform; and
• Not use the Platform to transmit viruses, malware, or other harmful material.

Submitting an enquiry or communication through the Platform does not create a doctor–patient, lawyer–client, or any other professional relationship between you and CTP Doctor. Any professional services are arranged directly between you and the relevant Service Provider, on terms you agree with that provider.

We may, with your consent, share your information with independent Service Providers to facilitate contact and care coordination.

We do not guarantee that a Service Provider will accept your matter or that any particular outcome will result. Service Providers are independent and responsible for their own conduct, licensing, and compliance.

To the extent permitted by law, CTP Doctor is not liable for the quality, timing, accuracy, or outcome of services delivered by any Service Provider.

Use of the Platform is generally free. Fees for medical, legal, or allied health services (including any insurer-billed arrangements) are a matter between you and the Service Provider and any applicable insurer or scheme rules.

Intellectual property in the Platform — including design, text, graphics, layout, software, and other content — is owned or licensed by us.

You may access and view the Platform for personal, non-commercial use. You must not reproduce, modify, distribute, or exploit Platform materials without our prior written consent.

The Platform and its content are provided on an "as is" and "as available" basis. Site content is general information only; it is not personal medical or legal advice.

To the fullest extent permitted by law:

• We make no representations or warranties as to accuracy, reliability, completeness, or suitability of information on the Platform;
• We do not warrant that the Platform will be error-free, secure, or uninterrupted; and
• We exclude liability for loss, injury, damage, or expense arising from your use of the Platform or reliance on its content, except where liability cannot be excluded under the Australian Consumer Law (ACL) or other applicable law.

You agree to indemnify and hold harmless CTP Doctor, Work Cover Doctors Australia Pty Ltd, and their directors, employees, and contractors against claims, losses, damages, liabilities, costs, or expenses (including reasonable legal costs) arising from your use of the Platform, your breach of these Terms, or your violation of law or third-party rights.

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and disclose personal information under the Privacy Act 1988 (Cth).

We may modify, suspend, or discontinue the Platform or any part of it at any time. We are not liable if the Platform is unavailable, including for maintenance or technical failure.

We may suspend or terminate your access to the Platform without notice if we reasonably believe you have breached these Terms or engaged in conduct detrimental to our operations or reputation.

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force and effect.

We may amend these Terms by publishing an updated version on the Platform. The updated Terms take effect when published. Continued use after publication constitutes acceptance of the changes.
