Do I Need a Lawyer for My CTP Claim? (NSW)

Short answer: not every NSW CTP claim needs a lawyer. Many people with clear liability and straightforward injuries get treatment and weekly payments without one. But when a claim is denied, cut off, or in dispute — or when injuries are serious — getting advice early can change how things play out.

When you probably don't need one (yet)

Even here, it's worth knowing what your options are and keeping every letter. Things can change, and the medical record you build now is what any later review relies on.

  • The other driver was clearly at fault and the insurer has accepted liability.
  • Your injuries are settling and the insurer is paying for treatment and any time off work.
  • You're getting clear, consistent certificates and the case manager is responsive.
  • You've had no letters disputing your injury, your treatment, or your capacity for work.

When it's worth getting advice

None of these mean your claim is lost. They mean the next step has legal consequences, and most solicitors who do NSW motor accident work will talk through an initial situation without charge — ask before you book.

  • The insurer denies liability, or says you were mostly at fault and you disagree.
  • Treatment is refused, or weekly payments stop and internal review doesn't fix it.
  • Your injury is classified as 'minor' (threshold) and you think that's wrong.
  • Your injuries are serious and you're told you may have a damages (common law) claim.
  • You're asked to give a formal statement, attend an insurer's medical, or sign something you don't fully understand.
  • A dispute is heading to the Personal Injury Commission.

Time limits to be aware of

The NSW scheme has time frames at several points — for lodging a claim, for requesting internal review of an insurer's decision, and for taking a dispute further. They can be short, and missing one can close off an option. If you've had an adverse decision, note the date on the letter and check SIRA or speak to a solicitor promptly rather than waiting to see what happens.

Choosing a solicitor

  • Ask whether they regularly run NSW motor accident (CTP) matters — it's a specific scheme with its own procedures.
  • Ask them to explain the costs agreement in plain English before you sign, including what happens with disbursements if the claim doesn't succeed.
  • Expect them to want your medical records early — that's normal, and a clear record from your treating team helps.
  • You're entitled to a second opinion and to change solicitors; you are never locked in by an introduction.
